Power of Attorney for Buying Indian Property from the UAE
Scope it narrowly, attest it properly, and never sign the general version someone hands you at the last minute.
Almost nobody flies to India for every signature a property purchase demands. So a Power of Attorney gets drafted, usually in a hurry, usually from a template, and usually far broader than the transaction requires. That last part is where the risk lives.
A PoA is not risky. A badly scoped one is
The instrument itself is ordinary and widely used. What separates a safe PoA from a dangerous one is not the document type, it is three choices: how narrowly it is scoped, who holds it, and how cleanly it can be revoked.
A general Power of Attorney hands someone broad authority over your affairs. A special Power of Attorney authorises named acts, for a named property, for a defined period. For a property purchase you want the special version, every time. If a document being put in front of you does not name the property, it is too broad for the job.
What to scope it to
- The specific property, identified by its full description and survey or unit number
- The specific acts — executing the sale deed, presenting it for registration, receiving the registered document
- A defined validity period rather than an open-ended one
- Named attorney, with identity details, not a role or a firm
Deliberately absent from that list: authority to sell, mortgage, lease or otherwise deal with the property. You are buying. The PoA should let someone complete a purchase on your behalf and nothing else.
Executing it from the UAE
The mechanics are procedural and they are where timelines slip.
- Have it drafted by a lawyer familiar with Indian property transactions — not a generic online template
- Sign it in the UAE before a notary
- Get it attested for use in India. Consular attestation is handled by the Embassy of India in Abu Dhabi
- Send the original to India — couriered, not scanned; registration offices want the original
- It is then adjudicated and stamped in the relevant Indian state before use
Start this before you need it. Attestation and courier time routinely add two to three weeks, and a purchase that is otherwise ready will simply sit until the paper arrives.
Who should hold it
The honest answer is: someone whose interests do not conflict with yours in this transaction. A family member is the common choice and usually fine. What is not fine is granting it to anyone on the selling side, or to a broker involved in the deal — the person representing you should not also be representing the counterparty.
Revocation
A PoA can be revoked, and a time-limited one lapses on its own. Both are worth having: the defined period means the authority ends even if you never think about it again, and the ability to revoke means a relationship that changes does not leave standing authority over your property.
